1. Acceptance of terms
Please read these Terms and Conditions ("Terms") carefully before using the BarX100 website, platform, or any web forms operated by BarX100 ("BarX100," "we," "our," or "us"). These Terms constitute a legally binding agreement between you and BarX100.
By accessing or using our website, submitting any web form, or interacting with any AI-powered feature, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you are using BarX100 on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms. If you do not agree to these Terms, you must immediately cease using our website and services.
2.Definitions
"Platform": The BarX100 website, subdomains, web applications, APIs, AI-powered tools, and all related digital properties.
"Services": All products, features, AI tools, content, and functionality made available through the Platform.
"User" / "you": Any individual or entity that accesses or uses the Platform, including visitors, registered users, and form submitters.
"Content": All text, data, images, outputs, and materials made available on or through the Platform.
"User Content": Any data, text, files, prompts, or inputs you submit through the Platform or web forms.
"AI Features": Automated, machine-learning-powered tools, chatbots, recommendation engines, and analytical features within the Platform.
"Web Forms": Online forms on the Platform used for contact, registration, subscription, inquiry, feedback, or any other purpose.
3.Eligibility and Acess
To use the Platform, you must:
Be at least 16 years of age (or 18 in jurisdictions where 16 is insufficient for contractual capacity)
Have the legal capacity to enter into a binding agreement
Not be located in a country subject to applicable trade sanctions or embargoes
Not have been previously suspended or banned from using the Platform
BarX100 reserves the right to refuse access to any user at its sole discretion, including where use is suspected to be fraudulent, abusive, or in violation of these Terms.
4.Account Registration and Web form Submission
4.1 Account Creation
Certain features of the Platform require you to register for an account. When registering, you agree to:
Provide accurate, current, and complete information
Maintain and promptly update your information to keep it accurate
Keep your login credentials confidential and not share them with third parties
Notify us immediately at support@barx100.com of any unauthorized use of your account
You are solely responsible for all activities that occur under your account. BarX100 is not liable for any loss or damage arising from unauthorized account access resulting from your failure to maintain credential security.
4.2 Web Form Submission
By submitting information through any web form on the Platform, you:
Confirm that all information provided is accurate, truthful, and not misleading
Grant BarX100 the right to use the submitted information in accordance with our Privacy Policy
Acknowledge that submission of a form does not guarantee a response, acceptance, or entry into any commercial arrangement unless explicitly stated
Agree not to submit false, fraudulent, or impersonating information
5. Permitted Use & Prohibited Conduct
5.1 Permitted Use
You may use the Platform and Services only for lawful purposes and in accordance with these Terms. Permitted uses include:

Submitting web forms to enquire about Services or request support
Viewing and engaging with Platform Content for informational purposes
5.2 Prohibited Conduct
You must not use the Platform to:
Violate any applicable local, national, or international law or regulation
Submit false, deceptive, or misleading information through web forms or the Platform
Attempt to gain unauthorized access to any part of the Platform, its servers, or connected systems
Reverse engineer, decompile, disassemble, or attempt to extract source code from our AI systems or Platform
Use automated scripts, bots, crawlers, or scrapers to access the Platform without prior written consent
Upload or transmit viruses, malware, or any malicious code
Interfere with or disrupt the integrity or performance of the Platform
Use the AI Features to generate, distribute, or store content that is illegal, harmful, defamatory, obscene, or infringes third-party rights
Attempt to circumvent, disable, or manipulate AI safety features or filters
Impersonate any person, entity, or BarX100 employee
Engage in any activity that could damage BarX100's reputation or business relationships
Violation of prohibited conduct provisions may result in immediate suspension of your access and may be referred to relevant authorities.
6. AI Features — Specific Terms
6.1 Nature of AI Outputs
BarX100 provides AI-powered features as part of its Services. You acknowledge and agree that:
AI-generated outputs are produced by machine learning models and may contain errors, inaccuracies, or incomplete information
AI outputs do not constitute professional, legal, financial, medical, or regulatory advice
You are solely responsible for evaluating, verifying, and exercising independent judgment before acting on any AI-generated content
BarX100 makes no guarantee that AI outputs will be accurate, appropriate, or fit for any particular purpose
6.2 Acceptable Use of AI Features
When using AI Features, you must not:
Submit inputs designed to manipulate, jailbreak, or otherwise circumvent AI safety controls
Use AI Features to generate content that promotes violence, discrimination, illegal activity, or harm to any person
Use AI outputs to impersonate or deceive others
Systematically extract AI outputs for the purpose of training competing AI systems
6.3 AI Feature Availability
AI Features are provided on an as-available basis. BarX100 reserves the right to modify, suspend, or discontinue AI Features at any time, with or without notice, without liability to you.
7. Intellectual Property
7.1 BarX100 Intellectual Property
The Platform and all Content, including but not limited to software, AI models, text, graphics, logos, interfaces, and compilations, are owned by or licensed to BarX100 and are protected by copyright, trade secret, patent, trademark, and other applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal or internal business purposes only. This licence does not include any right to:
Reproduce, copy, or distribute Platform Content commercially
Modify, create derivative works from, or adapt Platform Content
Use any data mining, scraping, or extraction methods on the Platform
Remove or alter any proprietary notices or labels
7.2 Your Content
You retain ownership of any User Content you submit to the Platform. By submitting User Content, you grant BarX100 a worldwide, royalty-free, non-exclusive licence to use, process, store, and display your User Content solely for the purpose of providing and improving the Services.
7.3 Feedback
If you provide suggestions, ideas, or feedback about the Platform or Services, you grant BarX100 an unrestricted, perpetual, irrevocable, royalty-free licence to use such feedback for any purpose without compensation or attribution to you.
8. Third-Party Links & Integrations
The Platform may contain links to third-party websites, tools, or services. These links are provided for convenience only. BarX100 does not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party site or service.
Your interactions with third-party services — including any integrations enabled through the Platform — are governed solely by those third parties' terms and privacy policies. BarX100 accepts no liability for any loss or damage arising from your use of third-party services.
9. Disclaimers & Limitation of Liability
9.1 No Warranties
THE PLATFORM AND ALL SERVICES, INCLUDING AI FEATURES, ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BARX100 DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI OUTPUTS.
BarX100 does not warrant that: (a) the Platform will be uninterrupted or error-free; (b) defects will be corrected; (c) the Platform is free of viruses or harmful components; or (d) AI-generated outputs will be accurate or complete.
9.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARX100 AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM, SERVICES, OR AI FEATURES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In jurisdictions that do not allow the exclusion or limitation of certain damages, BarX100's liability shall be limited to the fullest extent permitted by law. In no event shall BarX100's total aggregate liability to you exceed the greater of: (a) the amount you paid to BarX100 in the twelve months preceding the claim, or (b) USD $100.
10. Indemnification
You agree to indemnify, defend, and hold harmless BarX100 and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:
Your use of the Platform or Services
Your submission of any User Content or web form data
Your violation of these Terms or any applicable law
Your infringement of any third-party rights
Any misuse of AI Features, including generation of harmful or unlawful content
11. Suspension & Termination
BarX100 may, at its sole discretion and without prior notice, suspend or terminate your access to the Platform and Services if:
You breach any provision of these Terms
Your use of the Platform poses a risk of harm to BarX100, other users, or third parties
Required to do so by law or regulatory authority
Your account remains inactive for an extended period (currently defined as 24 consecutive months)
Upon termination, your licence to use the Platform immediately ceases. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, indemnification, and dispute resolution clauses.
You may terminate your account at any time by contacting support@barx100.com. Termination does not entitle you to any refund except as required by applicable law.
12. Modifications to the Platform & Terms
12.1 Changes to the Platform
BarX100 reserves the right to modify, update, discontinue, or restrict any part of the Platform or Services at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.
12.2 Changes to These Terms
We may revise these Terms from time to time. When we make material changes, we will update the Effective Date at the top of this document and, where appropriate, notify registered users by email or in-platform notification. Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of the changes.
We encourage you to review these Terms periodically. If you do not agree to amended Terms, you must stop using the Platform.
13. Governing Law & Dispute Resolution
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India without regard to its conflict of law principles.
13.2 Dispute Resolution
In the event of any dispute arising out of or relating to these Terms or the Platform, the parties agree to attempt resolution through good-faith negotiation for at least 30 days before commencing formal proceedings.
13.3 Jurisdiction
Subject to any mandatory consumer protection laws in your jurisdiction, you submit to the exclusive jurisdiction of the courts in Chennai for the resolution of any disputes that cannot be settled by negotiation.
13.4 Class Action Waiver
To the extent permitted by applicable law, you waive any right to participate in any class action, collective proceeding, or representative action against BarX100.
14. Regulatory Compliance & Export Controls
You represent and warrant that your use of the Platform complies with all applicable laws, including data protection laws, export control regulations, and anti-corruption laws. You agree not to use the Platform in any manner that would violate applicable sanctions, embargoes, or trade restrictions imposed by your country or any country in which BarX100 operates.

16. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and BarX100 regarding your use of the Platform.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Waiver: Failure by BarX100 to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment: You may not assign your rights or obligations under these Terms without BarX100's prior written consent. BarX100 may assign these Terms without restriction.
No Partnership: Nothing in these Terms creates a partnership, joint venture, agency, franchise, or employment relationship between you and BarX100.
Force Majeure: BarX100 is not liable for delays or failures in performance resulting from causes beyond its reasonable control, including natural disasters, government actions, cyberattacks, or infrastructure failures.
Language: These Terms are drafted in English. In case of any conflict between English and a translated version, the English version shall prevail.
